Hak untuk melawan

Hak untuk melawan adalah hak asasi manusia, meskipun ruang lingkup dan isinya masih kontroversial.^[2] Hak untuk melawan, tergantung pada bagaimana hak tersebut didefinisikan, dapat berupa pembangkangan sipil atau perlawanan bersenjata terhadap pemerintah tirani atau pendudukan asing; apakah hak ini juga berlaku untuk pemerintah non-tirani masih diperdebatkan.^[3] Meskipun Hersch Lauterpacht, salah satu ahli hukum terkemuka, menyebut hak untuk menolak sebagai hak asasi manusia yang paling tinggi, posisi hak ini dalam hukum hak asasi manusia internasional masih lemah dan jarang dibahas. Empat puluh dua negara secara eksplisit mengakui hak konstitusional untuk melakukan perlawanan, seperti halnya Piagam Afrika tentang Hak Asasi Manusia dan Hak Penduduk.
